Terms of Service

If you are less than 13 years of age, it is the responsibility of your parent or other legal guardian to determine whether any of the games or services are appropriate for you. You agree that you will be personally responsible for your use of Popyeah and for all of your communication and activity on Popyeah, including any content you contribute, and that you will indemnify and hold harmless Ganymede, its parent, affiliates, employees, officers, and directors from any liability or damages arising from your conduct on Popyeah, including any Content that you contribute. Online conduct should be guided by common sense and basic etiquette. You will violate the Terms of Service if you (or others using your account) do any of the following:

•	Harass, threaten, embarrass, or do anything else to another member or guest that is unwanted.
•	Disrupt the flow of chat in chat rooms with vulgar language, abusiveness, use of excessive shouting [use of all-caps], or flooding [continuous posting of repetitive text].
•	Transmit or facilitate distribution of content that is harmful, abusive, racially or ethnically offensive, vulgar, sexually explicit, defamatory, infringing, invasive of personal privacy or publicity rights, or in a reasonable person's view, objectionable. Hate speech is not tolerated.
•	Post or transmit chain letters or pyramid schemes; post or transmit any unsolicited advertising, promotional materials, or other forms of solicitation to other users.
•	Promote or encourage any illegal activity including hacking, cracking or distribution of counterfeit software.

•	Attempt to interfere with, hack into, or decipher any transmissions to or from the servers running Popyeah games
•	Attempt to solicit account information from other players.
•	Falsely present yourself as a Ganymede employee or Popyeah Administrator.
•	Use Web links or URLs in the forum or game chat whose content violates any of the Popyeah regulations above.
•	Use proxy servers or other methods to hide your real IP address in order to make the identification of the player more difficult or to break the security precautions.

If persons other than yourself access Popyeah on your computer, you are responsible for their actions. Thus, except for taking action against your account, Ganymede is also authorized to take action against your computer by blocking its IP address or the IP address of the entire local network your computer is connected to.

Ganymede reserves the right to refuse the access to the service to any individual or group of individuals without any legitimate cause or reason.

You agree that any information (photos, questions, game suggestions, tournament processes, etc.) submitted to Popyeah by you will become the sole property of Ganymede. You agree that all submissions will become the exclusive property of Ganymede without any compensation accruing to you. Profiles of players must be free of pornographic pictures, links and words, as well as to any references that are inconsistent with the Terms of Service.

You agree to processing of your personal data for statistical and marketing purposes by Ganymede, 31-425 Krakow, Al. 29 Listopada 45a/11 according to the regulation of data protection legal act of August 29, 1997 (Dz.U. nr 133 z 1997r.).

You agree that certain information about you may be given to Popyeah Administrators. This information is used by them to enforce Terms of Service and may include your nick, IP address and unique ID that your computer receives when you start playing games in Popyeah. This way they can determine what other nicks have been registered using this specific computer and take appropriate actions if necessary.

Ganymede reserves the right to remove at any time, without notice, any user-created content from the Popyeah server. Ganymede makes no representations or warranties, implicit or explicit, as to your legal right to participate in any game offered on thePopyeah nor shall any person affiliated, or claiming affiliation, with Ganymede have authority to make any such representations or warranties.

Ganymede reserves the right to send members service e-mails notifying the member of operational or other changes that may affect or significantly change the current services offered. Please note that members cannot opt out of such service e-mails because these service e-mails provide information critical for the operation of members' accounts.

RELATIONSHIP OF PARTIES
